An Illinois woman who wanted whisky, but got a cinnamon-and-whisky-flavored malt beverage instead, has sued the maker of Fireball for fraud.

Both bottles have a red cap, a yellow label with the word “Fireball” and a logo featuring a fire-breathing, dragon-like creature in red. Malt beverages, such as hard seltzers and wine coolers, have a fermented base and are usually flavored. The lawsuit said that “natural whisky and other flavors” was “a clever turn of phrase” because people might misread it as “natural whisky,” thinking it was a reference to the spirit, and not understand that it was a flavor. A class-action lawsuit was filed in Illinois at the beginning of the month alleging the brand was misleading consumers with a malt beverage.

"When viewed together with the Fireball distilled spirit brand name, the label misleads consumers into believing it is or contains distilled spirits." Customers "will think the Product is a malt beverage with added (1) natural whisky and (2) other flavors," it added. The mini-bottles, unlike the larger ones, do not contain any whiskey. The claim alleges that the phrasing, "Malt Beverage With Natural Whisky & Other Flavors and Carmel Color" is written in the "smallest allowed size."
