“We understand this process was difficult for the witnesses involved and we thank them for their participation.” Based upon provisions in the MLB collective bargaining agreement the Dodgers have until Jan 6, 2023 to make such a decision. The Dodgers are likely to pay Bauer the remaining $22,697,674.42 and release him, making Bauer a free agent. Scheinman, the arbitrator selected by MLB and the MLBPA, saying, Trevor Bauer violated Major League Baseball’s Joint Domestic Violence, Sexual Assault and Child Abuse Policy. In addition, the arbitrator docked Bauer’s salary for the first 50 games of the 2023 season (i.e., the period covering March 30, 2023, to May 23, 2023). Former Cy Young winner and Los Angeles Dodger pitcher Trevor Bauer has been reinstated by a neutral arbitrator after ruling on the league’s domestic violence policy, after commissioner Rob Manfred’s decision to suspend him for two full seasons (324 games) in April of 2022.

Bauer and his representatives long have pointed to the judge in the restraining order hearing saying that the woman had been “materially misleading” in her request for the order. The district attorney’s office said it had investigated Bauer on charges of “assault by means likely to cause great bodily harm, sodomy of a sleeping person and domestic violence.” When MLB Commissioner Rob Manfred imposed the suspension, Bauer said: “In the strongest possible terms, I deny committing any violation of the league’s domestic violence and sexual assault policy.” The league put Bauer on investigative leave that week and suspended him last April, and in the interim two other [women told the Washington Post](https://www.washingtonpost.com/sports/2022/12/22/trevor-bauer-appeal-decision-dodgers/) of similar experiences with Bauer. However, courts generally are wary of interfering with collectively bargained policies and procedures; Bauer would have to show those policies and procedures were not followed. He pitched in 17 games in 2021 and has been on leave or suspension for the Dodgers’ last 243 regular-season games. Bauer immediately appealed, and an arbitration hearing akin to a trial began in May. However, the arbitrator is allowing him to play for those first 50 games, in part because of his cooperation in repeatedly agreeing to an investigative leave during which he missed the last half of the 2021 season. The team was unaware of any decision on the appeal until shortly before the ruling was announced. Under MLB rules, when a player is reinstated from the restricted list out of season, his team has 14 days to activate him. 6 to decide, although the remaining $22.5 million of his salary is guaranteed whether they activate him or release him. Had the suspension been upheld in full, Bauer would have lost $60 million.

As Trevor Bauer fights for his career, his accusers fight back (The Washington Post)

Bauer, the Dodgers pitcher suspended after abuse allegations, is waging an intense, secretive battle with MLB and his accusers, records show.

In the call, she confronted Bauer about allegedly punching her in the head and vagina. “I would never purposefully set myself up for something like this, like, thinking, ‘Oh, if I get him to beat the s--- out of me, you know, and let him do whatever he wants, then I could do this,’ ” the woman said. But the woman, who described going “in and out of consciousness,” pushed back on his claim that everything was consensual. She shared with The Post a screenshot of a message she said was sent to her by her former manager at a bar. The detectives urged her to call Bauer that day in their presence. MLB eventually sent in a lawyer to sit in the same room as her, she said. And body-camera footage shows she volunteered the video to police detectives during her initial interview with them, explaining at the time that her smile in the footage was part of her “trauma response.” Her lawyer in the restraining order hearing, Lisa Helfend Meyer, did not respond to a request for comment on whether the video was turned over to Bauer’s lawyers during that proceeding. The Columbus woman said the experience caused her to break down in tears during her testimony. [denied the woman a restraining order](https://www.washingtonpost.com/sports/2021/08/19/trevor-bauer-restraining-order-denied/?itid=lk_inline_manual_37), and a police investigation ended with [no charges being filed](https://www.washingtonpost.com/sports/2022/02/08/trevor-bauer-no-criminal-charges-assault-allegations/?itid=lk_inline_manual_37). “I don’t get to forget the worst thing that happened to me.” It is against MLB’s domestic violence policy to “engage in conduct which is aimed at, or has the effect of, intimidating or tampering with” a witness or alleged victim in an investigation. When prosecutors then declined to charge Bauer, he posted a video to social media in which he called the woman a liar and denied striking her during sex, even though he had already acknowledged hitting her on a phone call recorded by detectives.

Bauer has built a reputation as a difficult teammate, but he is also considered one of the most forward-thinking, analytically minded pitchers in the sport. District Court Judge James Selna allowed the San Diego woman to proceed with her lawsuit and dismissed Bauer's defamation suit against one of her former attorneys. The Dodgers canceled Bauer's scheduled bobblehead night and removed his merchandise from their stores shortly after MLB first placed him on administrative leave in the summer of 2021, but they have barely commented on his situation publicly. The woman alleged that he choked her unconscious on multiple occasions, repeatedly scratched and punched her throughout her body, sodomized her without consent and left her with injuries that warranted a trip to the emergency room after rough sex. judge denied the San Diego woman a permanent restraining order, rejected charges of assault by means likely to produce great bodily injury, sodomy of an unconscious person and domestic violence. Bauer then became the first player to appeal, triggering a prolonged process in which a three-person panel -- consisting of one rep from MLB, another from the MLBPA and Scheinman, appointed from both parties -- reviews findings and interviews witnesses to determine whether to uphold, reduce or throw out a suspension. The San Diego woman testified three separate times, a source with knowledge of the situation said. Two other women from Ohio made similar assault allegations to The Washington Post, which Bauer and his legal team have also disputed. The Dodgers countered with only a short statement that read: "We have just been informed of the arbitrator's ruling and will comment as soon as practical." Bauer disputed her allegations and remains in litigation with the woman, whom ESPN has chosen not to name. Bauer looks forward to his return to the field, where his goal remains to help his team win a World Series." Bauer will be docked pay through the first 50 games of the 2023 season but will be officially reinstated on Friday.

The Dodgers Should Know Where They Stand on Trevor Bauer (Sports Illustrated)

Los Angeles has had months to prepare for the decision of whether to cut the pitcher or continue rostering him.

Months to think about what it would mean to have Bauer in uniform, taking the mound every five days, functioning as a representative of the club. The portion of his pay to be docked is about $9.5 million—leaving the Dodgers responsible for roughly $22.5 million. If the arbitrator’s decision seemed sudden—coming months into the process in the days immediately before Christmas—the team has had months to consider the questions that it raises. This front office is famously one of the sharpest in the sport. There may be some who see the arbitrator’s decision to reduce the suspension for immediate reinstatement as a declaration of innocence. It marks the end of a messy, complicated process that has now lasted a year and a half. And the whole time, the Dodgers have known it could end with a decision like this one. [The Washington Post](https://www.washingtonpost.com/sports/2022/04/29/trevor-bauer-abuse-accusations/)—and the league ultimately handed down Bauer’s suspension in April 2022. But they have had months to contemplate what matters to them, and what price they might place on those principles, and there is not much to gain by waiting. The backlash to the Browns has been, and continues to be significant. The accusations of sexual misconduct cannot be ignored. Pitching coaches and managers have engaged in differences of opinion with Bauer throughout his career. Bauer pitched with Cleveland until he was once again part of a July 2019, three-team trade. Pitcher Trevor Bauer Reinstated After MLB Suspension Reduced By ... (Forbes)

The Los Angeles Dodgers have until early next month to decide if the right-hander remains on the roster or if the club will cut ties.

The amount of games he was suspended is of no concern to my client and is a matter for the league and the union to be concerned about.” Can’t wait to see y’all out at a stadium soon!” Bauer wrote in the December 22 tweet. As MLB’s investigation of Bauer unfolded, two Ohio women who also accused the pitcher of sexual assault — and whose allegations were first reported by the Washington Post — cooperated with MLB in its probe, according to attorneys representing the women. “What is important, and confirmation of horrific allegations, is that the arbitrator (Scheinman) selected by MLB and the MLBPA affirmed that Trevor Bauer violated Major League Baseball’s Joint Domestic Violence, Sexual Assault and Child Abuse Policy,” Tacopina said in an email. The allegations included choking her to the point of unconsciousness during sex, sodomy and punching her in the face. The question is whether Bauer will still be pitching for the Dodgers after May 23, or with another MLB club. Bauer, who last pitched in the majors on June 28, 2021, already served 144 games of the suspension, and will be docked pay for the first 50 games of the 2023 season (March 30-May 23), according to a MLB statement. Maui prosecutors ended up dismissing the criminal case against Reyes after his wife refused to cooperate with authorities, but Manfred still suspended the switch-hitter 51 games in 2016. Pitcher Trevor Bauer may face a similar career crossroads now that his appeal of his MLB suspension has been resolved.
