Federal agents see chargeable tax, gun-purchase case against ... (The Washington Post)

The U.S. Attorney in Delaware, a Trump appointee, now must decide whether to charge Hunter Biden with tax crimes and a false statement related to a gun ...

The gun paperwork part of the investigation stems from 2018, a time period in which Hunter Biden, by his own account, was smoking crack cocaine. “I take this matter very seriously but I am confident that a professional and objective review of these matters will demonstrate that I handled my affairs legally and appropriately, including with the benefit of professional tax advisors,” Hunter Biden said in a statement at that time. “As agents, we would always include as many charges as we could, but it’s ultimately up to the prosecutor to decide which ones they will bring.” In a July 2019 phone call, Trump urged Ukrainian president Volodymyr Zelensky to investigate both Joe and Hunter Biden — part of a pressure campaign that led to the first of Trump’s two impeachment trials in Congress. “We put the investigation in the hands of a Trump appointee from the previous administration.” Therefore, a rendition of the case from such an ‘agent’ is inherently biased, one-sided, and inaccurate. Republicans have pressed the Biden administration to appoint a special counsel to take over the investigation into the president’s son, arguing the step was needed to ensure public confidence in the probe’s outcome. Any charging decision involving the Biden case is especially fraught because Trump and his allies have made accusations of corruption in Hunter Biden’s business dealings a key line of attack against Democrats, both before and after the 2020 presidential race. Trump and others argued the data on the laptop showed evidence of unethical and possible illegal business deals; Joe Biden and his supporters denounced the efforts as a smear. It could not be determined for this article whether the laptop and its contents were useful in the Justice Department investigation. That is the job of the prosecutors. Hunter Biden’s business dealings and consultancies in Ukraine and China, including being paid $50,000 a month by Ukrainian firm Burisma, have long attracted political scrutiny and questions about the ethics of his connections to foreign businesses given his father’s political influence.

The President, meanwhile, has repeatedly said he won’t interfere in the independence of the Justice Department. Biden described in media interviews last year that he was addicted to drugs, which raised the possibility he broke federal law when he bought the firearm. According to nonprofit fact-checking website [Politifact](https://www.politifact.com/article/2021/jun/14/donald-trumps-i-was-right-about-everything-fact-ch/), “nothing from the laptop has revealed illegal or unethical behavior by Joe Biden as vice president with regard to his son’s tenure as a director for Burisma, a Ukraine-based natural gas company.” It is unclear whether the contents of Hunter Biden’s laptop played a role in the Justice Department investigation, the Post reported Thursday. The Justice Department’s investigation was originally centered on Hunter Biden’s financial and business dealings in foreign countries, including his work for businesses and tycoons in Ukraine and China, starting when Joe Biden served as vice president. [CNN](https://www.cnn.com/2022/07/20/politics/hunter-biden-investigation-critical-juncture/index.html) in July. Ethical questions have been raised over the years about Hunter Biden’s consulting and investment work abroad, including whether he properly paid taxes for that work. Few individuals tend to face charges for false statements related to gun purchases, which the Justice Department calls “lying and buying,” according to the Post. The story about the laptop was amplified by many conservative outlets and claimed the cache of evidence from the computer implicated Hunter and other members of the Biden family in several scandals, including improper business deals as well as a conspiracy theory that Joe Biden engaged in illicit activities relating to his son’s employment with the Ukrainian natural gas and oil company Burisma.

The Feds Reportedly Have Enough to Charge Hunter Biden (New York Magazine)

Hunter Biden, the president's wayward son, may face federal charges for tax improprieties and lying on an application to buy a gun.

But while conservatives have pushed the unfounded claim that Biden was involved in a kickback scheme involving the Ukrainian company Burisma, with his father on the take, he is being investigated for more pedestrian — if still serious — conduct. In a statement to the Post, Biden’s lawyer Chris Clark focused on the confidentiality of the ongoing probe. The Post notes that it is “relatively rare” for such gun cases to be prosecuted and that prosecutors have wide discretion on whether to pursue them. Attorney General Merrick Garland has made assurances that there will be no political interference in the case. In October 2016, more and more people inside the FBI were starting to harbor serious doubts about decisions made above them, and they were starting to talk. A Trump appointee likely wouldn’t kill a strong case to protect the Biden family — and if there was interference from elsewhere in DOJ or the administration, he could make that known. [ wrote a book](https://www.simonandschuster.com/books/Beautiful-Things/Hunter-Biden/9781982151126) about it), he bought a gun. Indeed, one of the reporters who broke the Thursday story — Barrett — landed a similar scoop in October 2016 for the Wall Street Journal. That wouldn’t get him off the hook for past criminal conduct, and the [Wall Street Journal reports](https://www.wsj.com/articles/prosecutors-advance-tax-probe-of-hunter-biden-11648465200) prosecutors are examining whether Hunter “moved funds in a way to obscure his tax liability.” This seems to be an open-and-shut crime — he said on the form he wasn’t a drug user, but he was. Then, in 2018, the [tax inquiry became](https://www.wsj.com/articles/barr-worked-to-keep-hunter-biden-probes-from-public-view-during-election-11607653188) a broader criminal investigation into Hunter, conducted by the US attorney’s office in Delaware, examining possible money laundering and whether he was an unregistered foreign agent. It does reveal, though, that they think the evidence is strong enough to charge Hunter in two areas. (US Attorney David Weiss of Delaware, a Trump appointee, is overseeing the investigation.) However, agents do not get to make the decision about filing charges — prosecutors in the Justice Department do, and the story contains no details about their current thinking.
