Behind the Campaign to Put Election Deniers in Charge of Elections (The New Yorker)

The states' secretaries of state are supposed to insure election integrity, but a far-right coalition seeks to transform that office.

In Nye, where some [thirty thousand ballots](https://www.cnn.com/2022/08/26/politics/ballot-hand-counting-regulations-approved-in-nevada/index.html?s=03) are expected to be cast in the midterms, the long-standing clerk there, a Republican who opposed the change, resigned, and the county commissioners appointed Mark Kampf, a [Marchant supporter](https://whkradio.com/news/national/2020-results-denier-to-oversee-voting-in-rural-nevada-county/a19bfb5eb8ec62597ad891cd5bc8ba29) who questioned the outcome of the 2020 election, to replace her. A Republican operative in the state told me that, while many people who are registered automatically aren’t likely to cast ballots, polls show that unaffiliated moderates, who do vote, are trending Republican, and that may give an edge to Marchant. The Hamilton County Board of Elections gets questions from the public about the 2020 election and election security every day, even almost two years later.

As of Tuesday morning, 50 days out from the election, the Hamilton County Board of Elections has received 37,896 requests for absentee ballots. 12 in the early voting center at the Hamilton County Board of Elections. So the Hamilton County Board of Elections has banned them. Four rooms at the board of elections require both a Republican and a Democrat to use their passkey to enter. Without the cards of both a Democrat or a Republican, the rooms stay locked. A fleet of 26 trucks delivers the voting equipment from the polling locations to the board of elections to be tabulated. Elections officials want to drill into the public's consciousness that both Republicans and Democrats share equal oversight. So they must take a thumb drive to another computer in the building to upload the results for the public to see. "There are two common themes that we receive, distrust of the voting machines, and the other seeking reproduction of all of the documents created in the 2020 election," Linser said. An election official can't upload the results to the web from the counting room. Voting machines cannot access the internet, elections officials said. In the past two weeks, they have averaged about three a day, he said.

The last day to print and mail ballots to military and overseas voters is Saturday. Oregon was the first state to institute vote-by-mail, in which ballots are mailed to voters who can return them either by mail or at official, secured, drop-off boxes. Several county clerks are retiring in the next year or so, representing over a century of combined elections experience, Fagan said. “These are sort of copy-and-paste records request that we’re being flooded with,” she said. These days, there have also been calls for hand-counts, voting system certification and attempts to undermine trust in drop-off ballot boxes. "The lie is still impacting the operations of our elections workers, nearly two years later.”

It was a scheme that was successfully investigated and uncovered by the State Board of Elections. The 9th District scandal resulted in a redo and the successful election of Congressman Dan Bishop. Dowless was working for a Republican candidate in the 9th Congressional District. County election offices in Pa. challenged by surge of voting record ... (Williamsport Sun-Gazette)

With the Nov. 8 election less than two months away, county election offices across Pennsylvania are moving into crunch time for preparing for Election Day.

However, Honey argued they are an electronic tally sheet of all votes cast in the county, not the contents of a ballot box. That coincides with prominent Trump ally and MyPillow founder Mike Lindell’s call to his followers at a mid-August “Moment of Truth” summit to gather CVRs — cast vote records — from every county in the U.S. “The lies driving these RTK requests are the same lies which lead to the January 6, 2021, insurrection at the U.S. For that reason, Marks was hesitant to speak about those records, referring only to what was contained in court records. “Unfortunately, we have witnessed the coordinated weaponization of the RTK process for the last two years by anti-maskers, anti-vaxers, and election deniers,” Harvie said in an email to PennLive. It also logs the CVR files that requesters in each state obtained and shared with the website. The Office of Open Records executive director Liz Wagenseller said as of Thursday, her office had issued decisions on 34 election-related appeals so far this year and have 32 more that it is still reviewing. They speculate that those supporters are weaponizing laws aimed at promoting government transparency and accountability to make it more difficult for election officials to ensure a smooth election in November. “They do not deserve to be targeted and harassed,” he said. The strongest words on the situation, though, came from Bucks County Commissioners Chairman Bob Harvie, who is also chairman of the county’s Board of Elections. Montgomery County spokeswoman Kelly Cofrancisco said there’s been a “substantial increase in RTK requests” submitted to her county’s Voter Services Office. Daniel Kobrin, assistant attorney general representing the State Board of Elections, said in court that the General Assembly did not have the power to call a special session to override a veto. They’re asking to move when the work is done to an early enough time period so that it aligns with the vast majority of what other states do.” But she said a timeline change would not affect the integrity or fundamental process of counting ballots. In the courtroom, Cox’s lawyers argued that the situation did not warrant an emergency because the board already knew there would be an influx of mail-in ballots. “The process will be the same if it’s done a week before the election or a week after the election,” Patrick said. After assessing how long it took to certify results during the primary election, the board unanimously voted to seek action from the court last month. State lawmakers attempted to change the process during this year’s legislative session when they passed a bill that would have permanently removed the two-day wait provision, among other election law changes. The hearing comes after a primary cycle marked by an unprecedented deluge of mail-in ballots and extended delays that took nearly a month to certify results. Cox, who made election auditing a key plank of his primary platform, filed an objection to the state’s petition. If approved, the petition would allow election officials to begin canvassing and tabulating mail-in ballots Oct. After years of managing misinformation related to the accuracy of election results — much of it stemming from Trump — election integrity has become a key platform point for GOP candidates around the country as election officials strive to deliver timely, accurate and transparent results. The law originates from a period when mail-in ballots made up only a small fraction of the overall vote.

Assistant Attorney General Daniel Kobrin told a Montgomery County Circuit Court judge that Maryland voters are expected to cast a record number of mail-in ballots in the upcoming gubernatorial election. He later conceded that there are instances in which the courts intervene in elections matters, such as when judges order polling places to extend their hours following an emergency request from a candidate or citizen. “That speaks to the need to raise the threshold for objections,” Thorning said. Currently, it only takes the objection of one member of the House and one senator to begin debate on whether lawmakers should decline to accept a specific state’s electoral votes. “And they are preparing the way legally, to be able to do it by electing individuals who will have a say, in various respects, over the election results.” The candidate who receives a majority of the 538 electoral votes wins the presidency. At a set time after a presidential election, Congress assembles to formally count the electoral votes. The Senate bill is less specific about what constitutes a failed election. Large numbers of mostly Republican candidates for important state offices, as well as the House and Senate, have refused to say they will abide by the results of the elections scheduled for November. However, there are some disagreements about precisely how to reform current law, which was put in place by the Electoral Count Act of 1887.

After months of talks, House Democrats introduced the legislation on Monday and are holding a quick vote two days later in order to send the bill across the Capitol and start to resolve differences. Currently, only one lawmaker in the House and one lawmaker in the Senate has to object. House GOP leaders disagree, and are encouraging their members to vote against the legislation. The House vote comes as the Senate is moving on a similar track with enough Republican support to virtually ensure passage before the end of the year. Both Cheney and Lofgren are also members of the House committee investigating the Jan. The legislation under consideration beginning Wednesday is a direct response to the Jan.

The House should hold at least one hearing, thus allowing critics to vent and friendly amendments to be offered, rather than give a procedural excuse for some ill-motivated members to oppose it. Remember that the terrorist attack on 9/11 occurred on a mayoral Election Day in New York City. It would require that objections could be considered only if one-third of either chamber of Congress agree to join the original challenge, rather than allowing a single member to gum up the works. It would specify the limited grounds, rather than open-ended ones, on which members of Congress could object to the legitimacy of any particular electors. It would provide what should be obvious, but which some troublemakers dispute, namely that state legislatures responsible for setting up their states’ election methods cannot change the rules or results after Election Day. The House bill introduced this week, co-authored by Republican Liz Cheney of Wyoming and Democrat Zoe Lofgren of California, fills in almost all gaps with admirable and sensible specificity, with negligible grounds for confusion.
