Judge Jon Tigar of the United States District Court for the Northern District of California made the decision last Thursday in response to 2021 claims ...

Even singer Jessica Simpson (known by early aughts fans for sparking a debate on what qualifies as tuna) commented on the emerging claims. The fast-food chain also went on the defensive with an informational website called SubwayTunaFacts.com. The site asserted that “Subway Tuna Is Real Tuna” and that it “uses wild-caught skipjack tuna regulated by the Food and Drug Administration (FDA).” In a statement to TODAY, a Subway spokesperson said, “Subway serves 100% tuna. Amid the Dhanowa and Amin lawsuit, The New York Times sampled fish from three different Subway Los Angeles locations. The site still claims that the tuna sandwich is “a favorite among sub lovers” and that its "tuna is and has always been high-quality premium, and 100% real.” We are disappointed the Court felt it couldn’t dismiss the plaintiffs’ reckless and improper lawsuit at this stage.

Subway tuna lawsuit still hangs over the chain after judge's ruling (The Washington Post)

Subway's tuna sandwich lacks tuna, the plaintiffs claim in their amended suit. A judge dismissed some, but not all, of the claims.

Subway tuna is tuna,” Goodman wrote in an email to The Post. “We look forward to vindicating Subway once the Court is able to consider the evidence and we are very confident that judgment will be entered for Subway on each of the plaintiff’s claims.” AFT conducted more than 50 individual tests on 150 pounds of Subway’s tuna for Inside Edition and confirmed yellowfin and/or skipjack tuna in every sample.” “The Court finds that the complaint ‘as a whole’ is sufficiently specific about what is false and why,” Tigar wrote. The company has established a web page, SubwayTunaFacts.com, which tries to provide transparency on the chain’s supply chain as well as expert opinions on the content of Subway’s tuna. Tigar dismissed the revised lawsuit in October, saying the plaintiffs did not prove they had purchased the tuna products based on misrepresentations from Subway. Whether, and to what extent, a reasonable consumer expects cross-contact between various Subway ingredients is a question of fact.”

Judge: Subway can be sued over '100% tuna' claims (Live 5 News WCSC)

(CNN) - Have you ever bought a tuna sandwich from Subway? The sandwich chain says it's “100% tuna,” but some people think that claim is a little fishy.

On Tuesday, the judge in the case said it’s too soon to accept Subway’s argument and the lawsuit against the sandwich chain can move forward. Last year, two people filed a lawsuit in California saying Subway’s tuna partially or wholly lacks tuna as an ingredient and that it’s other types of fish. The sandwich chain says it’s “100% tuna,” but some people think that claim is a little fishy.
