A top aide said the Wisconsin Republican senator wanted to give Pence the list of pro-Trump electors as he prepared to certify the 2020 election.

Eastman’s correspondence throughout the post-election period, including with another pro-Trump lawyer Kenneth Chesebro, shows the two grappling with the challenge of convincing state legislatures to adopt Trump slates of electors and building it into their plans. Even as rioters swarmed the Capitol on Jan. 6 and sent Pence, Jacob and lawmakers into hiding, Eastman leaned on Pence to single-handedly delay the count of electoral votes, citing the possibility that the Pennsylvania legislature would reconvene and adopt an alternative slate. The goal was ultimately to present Pence with an apparent controversy: competing slates of electors certified by different government bodies — governors and legislators. Eastman wrote a memo later that month, which was then forwarded to the Oval Office by Trump campaign attorney Jenna Ellis, according to documents obtained by the Jan. 6 select committee. “I was aware that we got this package and that somebody wanted us to deliver to the vice president,” Johnson said. Eastman urged her to help identify false electors to meet and cast votes for Trump on Dec. 14, 2020, when the legitimate members of the Electoral College were required to meet and vote. Neither Raffensperger nor GOP legislators in Georgia complied with Trump’s push, and his effort in Georgia triggered an ongoing investigation by the Fulton County district attorney. Nevertheless, he said his office attempted to facilitate the delivery of the package from Johnson to Pence, but ultimately did not after Pence’s team rejected it. During the hearing, another theme emerged: State legislative leaders pleaded with Trump and Giuliani for any evidence to support their sweeping claims of fraud and irregularities. Trump’s own White House counsel’s office also raised doubts about the plan, according to testimony released by the select panel in court filings. Michigan State Senate leader Mike Shirkey recalled in video testimony how, after Trump tweeted out his phone number, he received thousands of messages from Trump supporters asking him to appoint Michigan’s electors through the legislature. But no state legislature responded to Trump’s demand, and Pence, without any genuine controversy, rejected the scheme as illegal.

Rep. Adam Schiff noted at the top of the hearing on Thursday that federal district Judge David Carter has argued that Trump and others “violated multiple federal laws by engaging in this scheme, including conspiracy to defraud the United States.” The Jan. 6 committee revealed on Tuesday that former President Donald Trump was “directly” involved in the illegal campaign to fabricate phony slates of electors in key swing states. Says he was aware of ask on Jan. 6 AM. The fake electors scheme involved Trump and his team working to get allies in swing states won by President Biden to fabricate slates of electors declaring Trump the winner, and for Pence to cite these slates of electors as justification for blocking the certification on Jan. 6. She did not refute anything revealed in the hearing. The committee also revealed on Tuesday that the Trump campaign was involved in the effort to transport the fake slates of electors from the states to Washington, D.C.; that Eastman asked the Republican National Committee to assist in the scheme; and that the White House counsel’s office informed key players like Giuliani and Chief of Staff Mark Meadows that the scheme was not legally sound.

To recap: On Tuesday, the committee released text messages showing that Johnson's top aide, Sean Riley, inquired with Vice President Mike Pence's staff on Jan.

But the point remains that there was this last-minute effort to get Pence legally invalid slates of electors, in the hope that he would change course. For the Archives to not even treat the slates as worthy of transmission would certainly reinforce just how problematic and potentially illegal all of the fake electors effort was. In addition, his top aide said in the texts shared by the Jan. 6 committee that Johnson himself would deliver the documents — but we are still meant to believe that Johnson wasn’t clued in on this at all. Q: So did you not know what was being talked about in terms of what this document was?JOHNSON: I was aware that we got this package and that somebody wanted us to [give it to] the vice president. We didn’t deliver it.Q: So you were aware of it on Jan. 6 – that morning – when your chief of staff texted the vice president’s office?JOHNSON: I was aware that we got something they wanted to be delivered to the vice president. There’s another aspect of this that doesn’t make sense: Riley’s claim that the National Archives hadn’t received the slates. Documents released by the Jan. 6 committee show that the archivist had indeed received the slates from Michigan and Wisconsin. Cheney raised the possibility that perhaps they had been received by the Archives but hadn’t been shared with Pence, because they weren’t legally valid. Q: Did you support his efforts to try to get the slates to the Vice President?JOHNSON: No. I had no knowledge of this. The dodginess of all of it was reinforced by a swift response from Johnson’s office, which assured that the senator himself had nothing to do with this. And Pence had already declared he wouldn’t go along with the plot. But Sen. Ron Johnson’s (R-Wis.) response to a new revelation from the House committee investigating the insurrection is up there on the list. Perhaps the chief example is Rep. Jim Jordan (R-Ohio) awkwardly and haltingly responding to questions about his contact with President Donald Trump that day.

In the run-up to Jan. 6, the Wisconsin Senator helped feed the Trump beast.

We may never learn the full story of Johnson’s possible involvement in trying to pass fake electors to Pence on Jan. 6. This, too, is in keeping with the Trump and Eastman plot: The delay would allow states time to “find” fraud, enabling certification of Trump electors. And Johnson claimed at the time he was merely seeking this investigation to calm voter fears that Trump’s loss was tainted. Since then, Johnson has described that violence as “largely peaceful” and has hinted that it might have been a false flag operation. By then, the election results had been extensively vetted in the courts and by state-level audits. “Johnson endorsed the scheme that worked hand in glove with the Trump-Eastman effort,” New York University law professor Ryan Goodman told me. It’s hard to square this story with Riley’s explicit claim that Johnson himself “needs” to pass something to the vice president. Once completed, individual states would evaluate the Commission’s findings and could convene a special legislative session to certify a change in their vote, if needed. Texts unearthed by the Jan. 6 select committee show a Johnson staffer trying to submit fake presidential electors during the congressional electoral count, in keeping with Donald Trump’s effort to cling to power illegitimately. The select committee revealed texts going back and forth between Johnson aide Sean Riley and Chris Hodgson, a staffer to Vice President Mike Pence, just after midday during the electoral count on Jan. 6, 2021: They cited “unprecedented allegations of voter fraud” and said this: Johnson did, in fact, lend support to key elements of Trump’s broader scheme to subvert his election loss as they were unfolding.

"The senator had no involvement in the creation of an alternate slate of electors and had no foreknowledge that it was going to be delivered to our office," she tweeted. "I was aware that we got this package and that somebody wanted us to deliver it so we reached out" to Pence's office, he told CNN in an interview. On Tuesday, Riley and Hodgson's exchange was presented by the select committee during its fourth official hearing around the Capitol riot. But as Politico's Kyle Cheney pointed out, the National Archives had already received the the necessary electoral votes from Michigan and Wisconsin by the time of Riley's writing.
