To the editor: When you look in the mirror, believe it. To the editor: I’m so tired of voters saying they don’t know how to stop gun violence. If that approach is too difficult to fathom right now, look at what the United Kingdom or Norway or Australia did after those countries experienced horrific shootings. .. At age 85, I can do something if I have the tool. .. .. I am done. Since then I have worked for candidates running for a seat on a local court up to the presidency. .. Along with the majority of Americans, I challenge my elected officials to finally do something about this violent and very preventable epidemic. I think everyone would agree that school should never be the place for such violence.

Did Justice Burger Call Gun Lobby's Take on 2nd Amendment a ... (Snopes.com)

Warren Burger was appointed to the U.S. Supreme Court by President Richard Nixon in 1969.

The very language of the Second Amendment refutes any argument that it was intended to guarantee every citizen an unfettered right to any kind of weapon he or she desires. The real purpose of the Second Amendment was to ensure that state armies – the militia – would be maintained for the defense of the state. The second part of this meme — “the real purpose of the Second Amendment was to ensure that state armies, the militia, would be maintained for the defense of the state” — and the third part — “The very language of the Second Amendment refutes any argument that it was intended to guarantee every citizen an unfettered right to any kind of weapon he or she desires” — comes from an articles Burger wrote for The Associated Press about the Bill of Rights in 1991. Burger, who was appointed to the Supreme Court in 1969 by then-President Richard Nixon and retired in 1986, supposedly said: The first part of this meme — “The gun lobby’s interpretation of the Second Amendment is one of the greatest pieces of fraud, I repeat the word fraud, on the American People by special interest groups that I have seen in my lifetime” — comes from an interview Burger gave to PBS News in 1991. The Gun Lobby’s interpretation of the Second Amendment is one of the greatest pieces of fraud, I repeat the word fraud, on the American People by special interest groups that I have ever seen in my lifetime.

Democrats Need to Start Talking About Repealing the Second ... (The New Republic)

For four decades, the conservative Federalist Society has been playing the long game with both the judiciary and the Second Amendment.

The battle cry used to be, “Close the gun-show loophole.” Now, after Uvalde, the long-shot dream is finding 10 Republican senators who would join with the Democrats to pass a red flag law that would allow the legal confiscation of guns in extreme mental health situations. In sharp contrast, gun control advocates for the last two decades have been playing the short game. Next month, the Clarence Thomas Supreme Court is poised to overturn New York State’s strict limitations on carrying a concealed handgun.

They were teary-eyed and shaken at the news there had been a mass shooting, another one, this time at an elementary school in Texas.

And that was what made all the difference. If we want to stop school shootings, if we want to protect children from random acts of violence, if want to save our society from murders at the hands of the murderous minded, we must address the root causes — sin. That was the bullet of the day. “This country was birthed in violence with genocide of the native people at the barrel of a gun. The evil of murdering children should not be dismissed. The horrors of senseless shootings should not be downplayed. This country was built on the backs of slaves with a gun to their backs.” “All of the firearms that were used [during Revolutionary War] had flintlock technology,” Battlefields.org wrote. But such evil is a condition of the heart, a matter of the mind, an outward show of a sickened soul. “I truly believe if Jefferson, Madison and Washington — if they all knew that the bullet would be invented, some 50 years after our revolution — I don’t know if they would have written [the Second Amendment] that way. And that’s what Moore does; that’s why the left loves him so. Leftists like Moore care little for truth, however, preferring instead to twist history to do today’s Democrat bidding.

After Uvalde: What the Second Amendment could learn from the First (The Hill)

The First Amendment isn't bound by absolutism — because limitless speech would foster lawlessness.

The First is multi-layered. The Second is neither multi-layered, nor even binary. We invite you to join the discussion on Facebook and Twitter. The First sides with victims, protecting against strains of verbal belligerence. The First defines our nation as a town square; the Second, a battlefield. The wisdom of humanity is understanding the flaws of humanity: illicit motives, impulses, and desired outcomes.

Is it time to repeal the Second Amendment? (LGBTQ Nation)

The relatively unregulated freedom to bear arms is literally "freedoming" Americans to death...

Rather than working to reduce the supply of firearms on our streets and in our homes, gun sales and ownership steadily increase. In addition, there have been significant drops in robberies involving firearms, and contrary to fears by some, no increase in the overall number of home invasions. Shame on the United States Congress and state legislatures for failing to pass comprehensive gun safety measures. Now we must put the Second Amendment out to pasture. The Falkland Islands comes in a distant second with 62.1 firearms per every 100 residents. The relatively unregulated freedom to bear arms is literally “freedoming” our people to death!

What makes individual gun ownership a lesser right? It's a right that only exists in the minds of a handful of hard-right Supreme Court justices who happen to ...

When war came in 1812 two things were immediately obvious: The number of soldiers then in the official U.S. military were far from enough to defend the nation, and the poorly organized civilian militias for which the Second Amendment was created were an absolute failure when it came to national defense. There were multiple drafts of the Second Amendment. Every one of them includes text explaining that this amendment exists only because it’s needed to provide for the nation’s defense. The very language of the Second Amendment refutes any argument that it was intended to guarantee every citizen an unfettered right to any kind of weapon he or she desires. To that end, they explicitly inserted the Second Amendment as an alternative means of providing national defense. The real purpose of the Second Amendment was to ensure that state armies – the militia – would be maintained for the defense of the state. It’s a right that only exists in the minds of a handful of hard-right Supreme Court justices who happen to be on the court at this moment.

Or will we just wait for the next time, the next mass murder, the next slaughter of the innocents? “Why do you spend all this time running for the United States Senate — why do you go through all the hassle of getting this job, of putting yourself in a position of authority — if your answer is that as this slaughter increases, as our kids run for their lives, we do nothing?” Murphy asked. What are we doing?” Murphy said on the Senate floor. “As a nation we have to ask, when in God’s name are we going to stand up to the gun lobby?” Biden asked. “Nearly 10 years after Sandy Hook — and 10 days after Buffalo — our country is paralyzed, not by fear, but by a gun lobby and a political party that have shown no willingness to act in any way that might help prevent these tragedies,” he said. Rep. Tony Gonzales, who represents Texas 23rd District, which includes Uvalde, has bragged in the past of his staunch opposition to gun control. On Tuesday, he issued a stinging statement about the lack of action in our blood-soaked and weary nation. “In 2020, I blocked bills proposing unconstitutional red-flag laws to strip citizens of their right to bear arms. Three others were wounded before the shooter, like Ramos a young man who was heavily armed and determined to kill, was captured. “For God’s sake, we have to have the courage to stand up to the industry. “The gun manufacturers have spent two decades aggressively marketing assault weapons, which make them the most and largest profit,” he said. At least 200 innocent people were murdered, and several of the shooters died as well.

Repeal the Second Amendment (The Philadelphia Inquirer)

I cried as I wrote this essay on Tuesday evening, after the school shooting in Uvalde, Texas. I am more than disheartened.

“Today we reaffirm that our Constitution still protects the right that enabled their sacrifice: the right of young adults to keep and bear arms.” Now on the U.S. Supreme Court’s caseload is a challenge to New York’s anti-public display of firearms. The Second Amendment’s right to “ a well-regulated militia” has exploded into an almost unchallengeable right to bear any kind of firearm (from handguns to assault weapons). They’re Trump appointees: Judges Ryan Nelson and Kenneth Lee. Judge Nelson, in his 55-page opinion, heralded the young patriots of America. “America would not exist without the heroism of the young adults who fought and died in our revolutionary army,” he wrote. I, who keep photos of the Sandy Hook children and their teacher near the Shabbat candles in my living room, forgot to mention another mass shooting. As a law professor, I recite those words in all of my first lectures for each class, no matter the topic.
