He added that Romero referring to the donation as a pledge, which generally indicated "some kind of commitment to give various amount over a period of time," not all at once. When asked whether it was "fair to say" she had not donated the promised $3.5 million, he said that, yes, that would be accurate. Speaking specifically about that $500K contribution, he said, "we believe that is a donor-advised fund that was set up by Elon Musk" and didn't come from Heard herself.

The court was shown documents including a thank you note to Heard for her pledge, as well as a pledge form and a schedule regarding the donation. The COO said that in the wake of the pledge the ACLU received $350,000 directly from Heard, $100,000 paid through Depp, $500,000 paid through a donor-advised fund and a further $350,000 also paid through a donor-advised fund, amounting to a total of $1.3 million. However, there have not been any concrete signs that Heard won’t eventually follow through, according to Dougherty. “I’m not aware of any indication that Ms. Heard has decided to no longer pay additional amounts,” Dougherty said in the deposition played Thursday. Doughtery also said that $500,000 of the $1.3 million donated thus far was from a charitable account that appeared to be “associated with Elon Musk” and he thought the tech billionaire had set up this account. There was some doubt around Heard paying the rest as she did not sign a “pledge form” that would make the donations legally binding, Dougherty testified. When the ACLU reached out to Heard in 2019 about future installments, Dougherty said, “We learned that she was having financial difficulties.” “She can be confident that this gift will help other women live safely and freely.” But according to a deposition played Thursday in Depp’s defamation trial against Heard, it appears that, to this day, only $1.3 million has been donated to the civil-rights nonprofit.

Her brother, a seventh-grader, said he was the subject of racially disparate punishment since kindergarten “sometimes for minor things such as putting his head on his desk.” The ACLU says school officials did not investigate but ignored the students’ claims. In a statement, the Oshkosh Area School District said it’s not in a position to comment on the complaint because the district hasn’t received it. The ACLU says even at one boy’s expulsion hearing, a school board official said the racial harassment was “not relevant.”
