The final rule updates the regulatory definitions of “frame” and “receiver” to ensure that firearms using split or multi-part receivers continue to be covered by our common-sense gun laws. As President Biden said during an event at the New York Police Department headquarters, if you use a ghost gun to commit a crime “not only are state and local prosecutors going to come after you, but expect federal charges and federal prosecution as well.” For example, if an individual builds a firearm at home and then sells it to a pawn broker or another federally licensed dealer, that dealer must put a serial number on the weapon before selling it to a customer. This final rule bans the business of manufacturing the most accessible ghost guns, such as unserialized “buy build shoot” kits that individuals can buy online or at a store without a background check and can readily assemble into a working firearm in as little as 30 minutes with equipment they have at home. [1] Because ghost guns lack the serial numbers marked on other firearms, law enforcement has an exceedingly difficult time tracing a ghost gun found at a crime scene back to an individual purchaser. His leadership and his record of innovation in fighting crime and violence make him ready from day one to aggressively and creatively address these pressing issues at the Director of ATF.

Last year, about 20,000 ghost guns were recovered in criminal investigations, a tenfold increase from 2016, the Justice Department said. Commercial manufacturers of the kits will have to be licensed and must add serial numbers on the kits’ frame or receiver. The requirement will apply regardless of how the firearm was made, whether it’s assembled from individual parts, kits or by 3D printers. The rule has been making its way through the federal regulatory process for nearly a year. “These guns are weapons of choice for many criminals," Biden said in a Rose Garden ceremony attended by victims and families of gun violence. The ATF proposed a rule last May that would change the federal definition of a firearm to include the parts used to make ghost guns.

Of the 12,088 guns recovered in Chicago last year, 455, or 3.76%, were ghost guns, according to data from the city, up from 130 ghost guns recovered in 2020, when ghost guns made up 1.15% of the 11,343 guns recovered.

"Felons who can't go to a gun store and legally purchase a firearm, or people who just don't want the government knowing what type of firearms they have." They would also be required to keep records of those purchases for as long as they're in business, rather than the 20 years under current requirements. That's a problem," John Miller, the NYPD's deputy commissioner for intelligence and counterterrorism, told CBS New York. Ghost guns are unregistered and untraceable homemade weapons that can be made with a 3D printer or assembled from a kit. Current law requires firearms manufacturers to include serial numbers on weapons, but doesn't regulate most parts, making these types of assembled guns hard for authorities to trace. The new rules will help law enforcement track and trace these firearms, which authorities say are increasingly involved in crimes.

And just last week, a police officer there was shot by a ghost gun-wielding 18-year-old, who police said had also shot three others. “Just as we opposed the Trump Administration’s arbitrary ban on bump stocks, GOA will also sue Biden’s ATF to halt the implementation of this rule,” Aidan Johnston, the group’s director of federal affairs said in a statement. For years, federal officials have been sounding the alarm about an increasing black market for homemade, military-style semi-automatic rifles and handguns. Congress has deadlocked on legislative proposals to reform gun laws for a decade, and executive actions have faced stiff headwinds in federal courts — even as the Democratic base has grown more vocal in calling on Biden to take more consequential action. It will probably be met with heavy resistance from gun groups and draw litigation in the coming weeks. The requirement applies regardless of how the firearm was made, meaning it includes ghost guns made from individual parts, kits, or by 3D-printers. Both Republican and Democratic administrations have failed to get nominees for the ATF position through the politically fraught process since the director’s position was made confirmable in 2006.
